論灘涂承包經(jīng)營(yíng)權(quán)的效力

摘 要

灘涂承包經(jīng)營(yíng)權(quán),是指公民、集體依法對(duì)集體所有的、或者國(guó)家所有由集體使用的灘涂進(jìn)行承包經(jīng)營(yíng)的權(quán)利。灘涂承包經(jīng)營(yíng)權(quán)的基本權(quán)利主要包括灘涂占有權(quán)、經(jīng)營(yíng)自主權(quán)、經(jīng)營(yíng)收益權(quán)及依法處分權(quán)等權(quán)能；基本義務(wù)主要包括不得隨便改變?yōu)┩哭r(nóng)業(yè)用途、合理開發(fā)利用灘涂、灘涂不得拋荒及負(fù)有容忍國(guó)家征收等義務(wù)。我國(guó)現(xiàn)行法律對(duì)灘涂承包經(jīng)營(yíng)權(quán)的權(quán)利與義務(wù)規(guī)定還有1些不足，立法機(jī)構(gòu)應(yīng)從以下幾方面完善我國(guó)灘涂承包經(jīng)營(yíng)權(quán)制度：規(guī)范灘涂所有人的行為；對(duì)公共利益進(jìn)行界定；健全補(bǔ)償機(jī)制；對(duì)灘涂承包經(jīng)營(yíng)權(quán)權(quán)利的行使加以限制。

Abstract

Shoals contract right Undertakings, refers to citizens, according to the collective right of collective ownership, or all countries of the collective use of the beach for contract rights. Chinese existing laws on the beach contracting the rights and obligations provided there are some inadequacies, Legislative bodies from the following aspects Perfection shoals contract right system: all the norms shoals; to define the public interest; sound compensation mechanism; shoals of contract rights for limiting on the exercise.
